But sometimes we know you just can't or you just don't care about some of the topics. We get it, and this episode is all about the new rule from the Department of Labor. And here's the deal. They basically brought back the economic realities test and this is a little quick quiz to figure out if a worker is really an employee or an IC, an independent contractor. So really quick, it's about six questions. So do they have boss-level skills? Does the worker run their part of the job like a mini-boss? Do they set their own prices and find their own customers? If yes, then they're playing the IC game. If a worker spends their own money to make their job cooler and more efficient, not just the basic stuff. If they're investing like a pro, then they're probably an independent contractor. If the worker's just visiting the club for a short period, or are they always there for longer times, or seasonal, if it's more visitor, seasonal style, probably independent contractor. Who's their boss? Does the worker get to make their own rules, like when and how much to charge, or does the club control all of that? If the worker's in charge, then they're more likely an independent contractor than an employee. Are they mission critical or just nice to have? Is their work super important to the club's main goal or is it something sort of a little bit extra? If it's non-essential, then the worker is usually an independent contractor. And depending on how they're super skilled, if they have some unique, very amazing skill that the club doesn't have and they can't teach, then they're probably an IC. So just a new rule in the playbook and of the ever-changing and evolving laws, rules, regulations and things that are going on in our world. But it's small but important because being able now to differentiate and because it it affects people on so many different ways and so many different levels, from pay to job security, to benefits and entitlements and you don't want to get that wrong. So in every state is different, every area is different, even though all those things change. So, at the end of the day, it's super important to make sure that you're aware and making sure that you are following whatever rules regulations that you have to, specifically because you don't want to face any penalties, lawsuits. That's the last thing any of us need. So make sure you are checking your staff roster, make sure everyone's labeled correctly. Rules are getting stricter, belts are being tightened, clamped, things are being clamped down. On Gotta, make sure we behave and do things that don't cost us any issues. At the end of the day. I am far from a lawyer or anything, so make sure you consult with professionals, do your own due diligence and research. Ha ha ha. So the ruling's out. We got six questions. Do they have boss level skills? Are they an investor extraordinaire in their equipment? How often are they there? Who's their boss? How critical of a role are they and how much of their skills is super skilled? They're super skilled, super stop. These six questions should be made into like a Jeff Fox worthy.
